The model law below is suitable as a basic template for any State law in the United States. The principles outlined will also be useful for any country or state looking to develop an assistance dog law.

NOTE: ANY STATES CONSIDERING THE ADOPTION OF THIS MODEL LAW WILL NEED TO CONSIDER THE ADOPTION OF CONFORMING AMENDMENTS TO THEIR CRIMINAL STATUTES, MOTOR VEHICLE STATUTES, LICENSING STATUTES, FAIR EMPLOYMENT STATUTES, FAIR HOUSING STATUTES, CIVIL RIGHTS STATUTES, PUBLIC UTILITY STATUTES/TRANSPORTATION STATUTES.
People with service animals must be allowed access to all public accommodations.
This right takes precedence over all state and local laws which might otherwise prohibit animals in those places such as Stores, Malls, Restaurants, Hotels/Resorts, Airlines,Cruises, Taxi cabs, Buses just to name a few.
Many landlords and business owners request to see registration paperwork or other identification and even though such paperwork is not required under law, it is often easier to provide the requester with a registration document or ID rather than argue the point or attempt to educate the person.
Emotional support dogs are protected under federal law Under the Fair Housing Amendments Act (FHAA) and the Air Carrier Access Act (ACAA), protects an individual who is entitled to an emotional support dog to assist them with their life.
The Fair Housing Amendments Act of 1988 (42 USC 3601, et seq.) prevents landlords and home owner associations from restricting your Emotional Support Animal from living with you.(even when there is a no pet policy in place) They are also not allowed to access special pet fees on you because of your pet.
The ACAA protects individuals by allowing the emotional support dog to fly with them in the cabin of an airplane (without having to pay any additional fees).
Any size or breed of dog can be an emotional support or service dog, emotional support dogs do not have to be professionally-trained to perform any task.
